Terms of Use of the INFLU:ON Platform · Update effective as of September 1, 2026
These are the Terms of Use of 2bananas s.r.o. and apply to all users of the INFLU:ON platform. "We", "our" and "us" refer to 2bananas s.r.o. "Influon" refers to this platform and the services we offer, including the Influon app for iOS, the Influon app for Android, the Influon API, Influon embeds, hosting, server, and AI infrastructure services, www.influon.cz, and other websites of 2bananas. By using Influon, you agree to these terms and to the other policies we publish, including the Privacy Policy. Please read them carefully and let us know if you have any questions. Information about our data processing practices can be found in our Privacy Policy and Cookie Policy. We collect, use, and share information in accordance with these policies.
Summary: To use Influon as a User, you must be at least 13 years old. To use Influon as a Creator, you must be at least 18 years old and be a self-employed person with an active business ID (IČ). In both cases, you or your legal representative are responsible for your account.
When you create an account, you must provide us with accurate information, in good faith, and you agree to update your information if it changes. You must be at least 18 years old, or have the permission of a parent or legal representative, to create a Creator page on Influon or to purchase an offer or subscription on Influon. To subscribe to an adult/18+ Creator or to purchase an offer related to such a Creator, you must be at least 18 years old. You are responsible for everything that happens while anyone is logged into your account, as well as for the security of your account. If you believe your account has been compromised, contact us immediately.
A Creator account becomes active only once the payment gateway has been fully activated. Activation of the payment gateway is free of charge and requires verification and validation of your identity by our partner Comgate, a.s., which is supervised by the ČNB (Czech National Bank). If you do not wish to activate the payment gateway, we will not be able to provide our services for creators, and such an account will be cancelled.
Summary: Be responsible and do not violate our terms or policies.
You are responsible for all activity on your account. If you violate our terms or policies, we may terminate your account. Do not do anything unlawful, offensive toward others, that misuses Influon in a technical manner, or that misuses Influon in an unintended way that is harmful to us — for example, using the free features of the creator platform as a substitute for paid hosting storage (we offer hosting, server capacity, and data storage separately as part of paid infrastructure services, see below). If you are a Creator earning money on Influon, we may be exposed to risk based on what you do with those funds. As a result, we may also look at what you do outside of Influon. These terms and our policies cover most issues, but if you find a new and creative way to harm Influon or our community, we may take action to prevent it.
Summary: A Creator is someone who activates the so-called Creator Mode after completing basic registration on INFLU:ON. They may also, for example, create a page on Influon in order to communicate with fans who purchase memberships or offers of Creators' products and services.
To become a Creator, simply launch your page and start with an offer or membership. When you join Influon, you become part of the Influon community. You may use the Creator tools we provide, among other things, to showcase your creations, engage with the Influon community, and provide goods to Customers through our service. Membership is for your most passionate fans. On Influon, you can offer your fans something exciting that gives them the special benefits they want, including additional access, merchandise, exclusive creations, and engaging community experiences. In return, you receive loyal support from your fans and revenue from memberships and offers purchased by fans on Influon.
The operator of Creator pages is the Creator themselves — the owner of the profile. All terms and conditions and terms related to the handling of personal data are the responsibility of the Creators, and Influon does not enter into this business relationship between the Creator and the Customer. The exact wording of the terms and conditions and the handling of personal data is always available before submitting a form for purchase, subscription, or any provision of personal data.
If you violate these Terms of Use, we may suspend or fully cancel your account.
Summary: The INFLU:ON platform is provided free of charge to all Creators and Users who meet the conditions for opening an account.
The features of the platform are described at www.influon.cz. Individual limits are listed at www.influon.cz/cenik, including a list of the platform's specific key features.
Special terms apply to e-mailing — the bulk sending of electronic messages by e-mail. The unlimited e-mailing limit applies only if the Creator has had total revenue exceeding €4,000 (excluding VAT, if a VAT payer) over the preceding 12 months. If such revenue is not reached, Influon will charge a fee for providing the e-mailing service for the preceding 12-month period. The final price is set at €4 for each commenced and sent batch of 1,000 e-mails (€0.004 / e-mail). The service fee will be sent as an electronic invoice / tax document to the Creator's e-mail address provided at account registration, with a due date of 5 business days. The billing details used will be the Creator's invoicing details reported during payment gateway activation.
As a Creator, you can sell directly through the platform. From an accounting perspective, we do not enter into the relationship between the Creator and their customers. All funds paid by the Creator's customers go directly to the Creator's bank account. The INFLU:ON platform charges fees for its use only on completed payments — paid orders only. The amount of the fees is published at influon.cz/cenik. Every Creator is required to choose one of the offered plans. The plan may be changed once every three months, always starting at the beginning of a new month. Some Creators may have different fees under individual arrangements. As the default payment gateway for Creators, we provide a solution from COMGATE a.s., which holds a VISA and Mastercard Acquiring licence, a European payment institution licence, and PCI DSS Level 1 security certification.
Where payment by end Customers is made through the COMGATE a.s. payment gateway, the billing of fees for use of the INFLU:ON platform is handled by the COMGATE a.s. payment gateway.
Where payment by end Customers is made outside the COMGATE a.s. payment gateway, we handle the billing of fees for use of the INFLU:ON platform ourselves, by way of retrospective invoicing to the Creator — the recipient of the revenue.
Influon offers add-on services for Creators, the offering of which is listed at www.influon.cz/cenik. Unless stated otherwise, add-on services are arranged individually via the e-mail address spoluprace@influon.cz.
Summary: We now also offer hosting, server capacity, and the operation of AI agents. You are responsible for your content, your data, and for what your AI agents do. We operate the service with due care, but without guaranteeing uninterrupted availability — your own backups are your responsibility.
As part of the paid infrastructure services, we provide you with access to server and computing capacity, hosting of websites and applications, a runtime environment, data storage, development tools (e.g., MCP servers), and the operation of AI agents. The scope and prices are set out at www.influon.cz/cenik; the commercial aspects of these services are further governed by our Terms and Conditions (Article 3).
You are responsible for the lawfulness of the content and data that you store or operate, and for having the necessary rights and consents to them. It is prohibited to operate or store content and activities that are unlawful, infringe the rights of third parties, contain malicious code, are used for phishing, sending unsolicited messages (spam), unauthorized cryptocurrency mining, attacks on other systems, or that place an unreasonable burden on shared resources.
If you operate AI agents or automations, you are fully responsible for their configuration, actions, and outputs, as well as for all costs and resource consumption caused by their operation. AI outputs may contain inaccuracies — check them before use.
We operate the infrastructure with reasonable professional care on our own servers, or in data centres in the Czech Republic / European Union, but without a guarantee of uninterrupted availability (without a contractual SLA), unless agreed otherwise. You are responsible for backing up your own data. In the event of a breach of the terms, or a threat to security or operation, we may restrict or suspend the service. After termination of the service, export your data within a reasonable period — after that period has elapsed, we may permanently delete it.
If, through our infrastructure services, you process the personal data of third parties, you are the controller of such data and we are the processor, processing it solely on your instructions and for the purpose of providing the service; upon request, we will enter into a data processing agreement (DPA) with you pursuant to Art. 28 GDPR.
These terms are effective as of November 3, 2024; the update regarding hosting and AI infrastructure services is effective as of September 1, 2026.
