For the sale of digital products, subscriber profile, and the provision of hosting and AI infrastructure services · Effective as of September 1, 2026
These Terms and Conditions govern the conditions for the purchase of digital products, access to the subscriber profile, and the provision of hosting, server, and AI infrastructure services on the INFLU:ON platform, www.influon.cz (hereinafter the "Service"). Please read the following terms carefully before using our Service.
1.1. This document constitutes a legal agreement between you, as the user, and 2bananas s.r.o., IČ: 21255857, Nové sady 988/2, Staré Brno, 602 00 Brno (hereinafter the "Provider").
1.2. By using our Service, you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree with these terms, you may not use our Service.
2.1. We provide digital products such as e-books, videos, music, graphics, online courses, or other digital content, and we also offer a subscriber profile where you can purchase access to exclusive content and benefits.
2.2. The subscriber profile gives you access to certain benefits depending on the subscription level you choose. These benefits may include access to exclusive content, bonus materials, personal interactions, or other services.
2.3. We now also provide hosting, server, and AI infrastructure services — in particular, the operation of websites and applications, server and computing capacity, a runtime environment, data storage, development tools (e.g., MCP servers), and the operation of AI agents and automations (hereinafter the "Infrastructure Services"). Further terms of the Infrastructure Services are governed by Article 3.
2.4. The Infrastructure Services are intended primarily for entrepreneurs and are used in connection with their business activities. The current scope, plans, and prices are set out at www.influon.cz/cenik.
3.1. Scope. As part of the Infrastructure Services, we provide you with access to server and computing capacity, hosting of websites and applications, a runtime environment, data storage, development tools (e.g., MCP servers), and the operation of AI agents, to the extent of the chosen plan or an individual arrangement published at www.influon.cz/cenik.
3.2. Availability. We provide the Infrastructure Services with reasonable professional care, but without a guarantee of uninterrupted or outage-free availability (without a contractual SLA), unless agreed otherwise in writing. We are entitled to carry out both planned and unplanned maintenance; we will endeavour to inform you of planned maintenance reasonably in advance.
3.3. Backups. You are responsible for backing up your own data, content, and configurations. We do not guarantee that we perform backups of your data or their restoration, unless expressly agreed otherwise; we recommend maintaining your own independent backups.
3.4. Customer Data and Licence. Data, content, and applications that you store or operate through the Infrastructure Services (hereinafter "Customer Data") remain your property. You grant us a non-exclusive licence, for the duration of the provision of the Infrastructure Service, to store, process, transmit, and, where applicable, back up such Customer Data to the extent necessary for the provision of the Infrastructure Service.
3.5. Responsibility for Content. You are responsible for the lawfulness of the Customer Data and for having the necessary rights and consents for its operation. It is prohibited to store or operate content or activities that are unlawful, infringe the rights of third parties, contain malicious code (malware), are used for phishing, sending unsolicited messages (spam), unauthorized cryptocurrency mining, attacks on other systems, or that place an unreasonable burden on shared resources. Detailed rules of use are governed by the Terms of Use.
3.6. AI Agents. If, as part of the Infrastructure Services, you operate AI agents or automations, you are fully responsible for their configuration, actions, and outputs, as well as for all costs and resource consumption caused by their operation. AI outputs may contain inaccuracies; you are responsible for checking them before use.
3.7. Location of the Infrastructure. We operate the Infrastructure Services on our own servers, or in data centres in the Czech Republic / European Union.
3.8. Restriction and Suspension. In the event of a breach of these terms, a threat to security, operation, or the rights of third parties, or on the basis of a justified request from a public authority, we are entitled to temporarily restrict or suspend the Infrastructure Services; where possible and permissible, we will inform you accordingly.
3.9. Termination and Deletion of Data. After termination of the provision of the Infrastructure Service (by notice, cancellation of the account, or due to non-payment), you may be requested to retrieve (export) the Customer Data within a reasonable period. After that period has elapsed, we are entitled to permanently delete the Customer Data. We recommend exporting your data in a timely manner.
4.1. In order to use the Service, you must register on the platform and create an account.
4.2. You are required to provide accurate, up-to-date, and complete information upon registration.
4.3. You are responsible for protecting your account and login credentials, and for all activity carried out through your account.
5.1. The prices for our digital products, subscriptions, and Infrastructure Services are set out on the Service's website and may be updated at any time.
5.2. Subscriptions are charged on a monthly or annual basis, depending on the level chosen.
5.3. Payments for digital products or subscriptions are made by card payment, Google Pay, Apple Pay, bank transfer, or other available options.
5.4. Prices are stated in CZK and include all applicable taxes, unless stated otherwise.
5.5. Online payments for us are processed by the Comgate payment gateway. The service provider, Comgate a.s., is a licensed payment institution operating under the supervision of the Czech National Bank. 5.6. The Infrastructure Services are generally charged on a recurring basis (monthly or annually) according to the chosen plan, or according to actual resource consumption (e.g., computing power, data storage, data transferred, operation of AI agents). Current prices and billed units are set out at www.influon.cz/cenik.
5.7. For the resources consumed and the Infrastructure Services provided, we may issue you an invoice / tax document with the due date indicated on the document. In the event of late payment, we are entitled to restrict or suspend the Infrastructure Service in accordance with Article 3.8.
6.1. All content that we provide as part of digital products and subscriptions is protected by copyright and other intellectual property rights.
6.2. By purchasing a product or subscription, you obtain a non-exclusive, non-transferable licence to use it solely for personal purposes, unless stated otherwise.
6.3. It is not permitted to copy, distribute, modify, publish, or otherwise misuse the content without the Provider's prior consent.
6.4. Customer Data (Article 3.4) remains your property; you grant us a licence to host and process it for the purpose of providing the Infrastructure Service in accordance with Article 3.4.
7.1. The subscription may be cancelled at any time through the account. After cancellation, access to exclusive content will remain available until the end of the current billing period.
7.2. Digital products are not refunded after purchase, given the nature of these products (digital and immediately accessible).
7.3. In the event of a product malfunction or technical problems, you may contact our support to resolve the situation.
7.4. The Infrastructure Services may be terminated at the end of the current billing period, unless agreed otherwise. Resources already consumed and Infrastructure Services already provided are non-refundable.
8.1. The Provider bears no liability for any damages arising in connection with the use of the Service, unless expressly stated otherwise.
8.2. You are responsible for using the Service in accordance with applicable law and for not infringing any copyright or other rights of third parties.
8.3. Given the nature of the Infrastructure Services, we bear no liability, to the extent permitted by law, for outages and unavailability of the service, for loss or damage to data, for lost profit, or for indirect and consequential damages. You are responsible in particular for your own backups (Article 3.3), for content and data (Article 3.5), and for the operation of AI agents (Article 3.6).
8.4. Where our liability is established, the total compensation for damages is limited, to the extent permitted by law, to the amount paid for the relevant Infrastructure Service during the 6 months preceding the occurrence of the damage.
9.1. Your privacy is important to us. We process personal data in accordance with our Privacy Policy.
9.2. The Provider will handle your personal data in accordance with applicable data protection laws.
9.3. If, through the Infrastructure Services, you process the personal data of third parties, you are the controller in relation to such data, and the Provider is the processor, processing personal data solely on the basis of your instructions and for the purpose of providing the service. Upon request, we will enter into a data processing agreement (DPA) with you pursuant to Art. 28 GDPR.
9.4. We process personal data within the European Union. Any transfer of personal data outside the EU/EEA takes place only where appropriate safeguards are ensured in accordance with GDPR.
10.1. The Provider reserves the right to change these Terms and Conditions at any time. You will be informed of such changes through a notice on the Service's website.
10.2. By using the Service after the changes have been made, you agree to the new Terms and Conditions.
11.1. Based on your consent, the Provider is entitled to send you commercial communications, in particular offers of digital products, services, educational materials, subscriptions, news, and information relating to marketing, business, and content creation.
11.2. You grant consent to receive commercial communications upon registration, purchase of a product, or another appropriate interaction with the Service. This consent is voluntary and may be withdrawn at any time.
11.3. You may withdraw your consent:
11.4. After the consent is withdrawn, we will stop sending commercial communications without undue delay. This does not, however, affect the sending of messages necessary for the performance of the agreement or of a technical nature (e.g., information about payments, access, or changes to the services).
11.5. As part of personalizing offers and increasing the relevance of communications, the Provider may use information about how you use the platform, which products you purchase, and what content you are interested in. This information is used solely for the Provider's marketing purposes and is not shared with third parties, unless stated otherwise in the Privacy Policy.
11.6. Commercial communications are sent in accordance with the legal regulations concerning electronic communications and the protection of personal data.
